The policy changed after it was bought out by Facebook. I would imagine Facebook has several spin doctors trying to figure out how to stop the mass exodus...Word got out that Facebook can now utilize any and all photos with no repercussions for advertisement purposes with the "owners" of the pictures receiving nothing in return...

The most recent update to the policy contained the following "....This means that other users may search for, see, use or share any of your user content that you make publicly available through the service, consistent with the terms and conditions....." 'User content' includes comments and 'other users' also include anyone who facilitates the operations of Instagram which in this case will obviously include Facebook. Note that 'use' is not defined and sits inconspicuously between see and share as though it's an action of the same inconsequential value. No wonder people are dropping off like flies and that's very shortly to include me.
